Welcome to KIKEX Studio. These Terms of Service ("Terms") govern your access to and use of our website (kikexstudio.com) and our services, including Web Development, Branding, Graphic Design, and Automation Solutions (including n8n integrations). By accessing or using our Services, you agree to be bound by these Terms.
1. Services
KIKEX Studio provides digital services tailored to your business needs, including but not limited to:
- Web Development: Custom websites, landing pages, and web applications.
- Branding & Design: Logo design, visual identity systems, and graphic assets.
- Automation Solutions: Workflow automation using n8n, API integrations, and custom scripts.
2. User Obligations
You agree to use our Services only for lawful purposes. You must not use our Services:
- In any way that breaches any applicable local, national, or international law or regulation.
- To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material (spam).
- To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs.
3. Intellectual Property
Unless tailored by a specific service agreement:
- Ownership: Upon full payment, you will own the final deliverables created specifically for you. KIKEX Studio retains the right to use the work for portfolio and marketing purposes unless a Non-Disclosure Agreement (NDA) is signed.
- Pre-existing IP: KIKEX Studio retains ownership of all pre-existing tools, libraries, and methodologies used to create the deliverables.
- Client Materials: You grant us a license to use any materials you provide (logos, text, images) solely for the purpose of completing your project.
4. Payment Terms
- A deposit of 50% is generally required before work typically commences.
- The remaining balance is due upon project completion and before final file delivery or live deployment.
- Invoices are due upon receipt unless otherwise specified in your project proposal.
5. Third-Party Services & Google APIs
Our Services may integrate with third-party applications and services, including but not limited to Google APIs (e.g., for Gmail, Drive, Calendar integrations via n8n).
Google API Disclosure
Our applications (including n8n-KIKEXstudio) use Google APIs to facilitate automated task management and workflow integrations. Our use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Data Privacy: We do not verify, share, or use your Google user data for training third-party AI models. Your data is processed strictly to execute the workflows you authorize within your private instance.
6. Limitation of Liability
To the fullest extent permitted by law, KIKEX Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content.
7. Termination
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
8. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
